1. Operator
BMarker is operated by Bytescale LLC. References to "BMarker," "Bytescale," "we," "us," or "our" refer to Bytescale LLC.
2. The service
BMarker provides tools for recording and importing transactions, reviewing portfolio history, calculating holdings and performance, comparing results with benchmarks, and intentionally sharing selected portfolio information. Features may change over time, may be offered in beta, or may be limited by plan, data availability, or technical constraints.
BMarker does not execute trades, hold money or securities, connect to brokerage custody, or act as a broker, investment adviser, fiduciary, tax preparer, or accounting firm.
3. Eligibility, accounts, and access
- You must be legally able to form a binding contract to use BMarker.
- You are responsible for all activity that occurs under your account.
- You must provide accurate account information and keep your credentials secure.
- You may not share access or use an authentication method in a way that violates law, contracts, or these Terms.
- You must promptly notify us if you believe your account has been compromised.
4. Your portfolio data
You retain ownership of portfolio information, transaction rows, notes, and other content you submit. You grant Bytescale a limited license to host, process, transmit, and display that content only as needed to operate, secure, support, and improve BMarker.
You are responsible for reviewing imported, manually entered, inferred, and calculated values before relying on them. Broker exports and market-data sources can contain errors, omit information, use unexpected formats, or change without notice.
5. Market data, analytics, and no financial advice
Prices, benchmark history, holdings, returns, risk measures, charts, and other analytics may rely on third-party data, cached data, user input, and assumptions you select. Publication timing, corporate actions, source formatting, market-data coverage, and third-party outages can affect completeness, freshness, and accuracy. Past performance does not guarantee future results.
BMarker is provided for informational and recordkeeping purposes only. Nothing in the service is investment, trading, legal, tax, accounting, or other professional advice, or a recommendation to buy, sell, or hold any security. You are responsible for evaluating the service and independently verifying information before making financial or reporting decisions.
6. Share pages
You choose whether to publish a BMarker share page and which information it contains. You are responsible for confirming the page's privacy settings and content before sharing a link. Anyone who can access a share page may save, copy, or redistribute its contents.
You must have the right to publish the information you share and must not use share pages to disclose another person's confidential information, impersonate others, mislead viewers, or violate law or third-party rights. Disabling a page revokes its BMarker links but cannot erase copies already made by other people or services.
7. Acceptable use
You agree not to misuse BMarker, attempt unauthorized access, interfere with service operation, transmit malicious code, circumvent access controls or rate limits, use automation that unreasonably burdens the service, violate applicable law, or infringe the rights of others.
We may investigate suspected misuse and impose reasonable safeguards, including rate limits, access controls, suspension, or termination, to protect the service and its users.
8. Third-party services
BMarker relies on third-party providers, including infrastructure, database, networking, authentication, email-delivery, and market-data providers. Their availability and behavior are outside our control, and their services may be governed by their own terms and privacy policies. We are not responsible for third-party outages, changes, or failures outside our control.
9. Billing
If BMarker offers paid features and you choose one, the pricing, renewal, cancellation, tax, and billing terms shown at purchase apply. Unless a purchase flow states otherwise, charges are non-refundable except where required by law.
10. BMarker intellectual property
BMarker, its software, interface, branding, documentation, and original content are owned by Bytescale or its licensors and are protected by applicable intellectual-property laws. These Terms do not grant you ownership of the service. If you provide feedback, you allow us to use it without restriction or compensation, while we remain free to disregard it.
11. Availability and disclaimers
We may modify, suspend, or discontinue any part of BMarker at any time. To the maximum extent permitted by law, BMarker is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory. We do not guarantee uninterrupted availability, error-free operation, data preservation, or the accuracy or suitability of any particular transaction, price, benchmark, calculation, or report.
12. Limitation of liability
To the maximum extent permitted by law, Bytescale and its owners, employees, contractors, and providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost opportunities, trading losses, lost data, or business interruption arising from or related to BMarker.
To the maximum extent permitted by law, Bytescale's aggregate liability for all claims arising from or related to BMarker will not exceed the greater of the amount you paid for BMarker during the twelve months before the event giving rise to the claim or one hundred U.S. dollars. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
13. Suspension and termination
You may stop using BMarker at any time. We may suspend or terminate access when reasonably necessary to protect the service or its users, prevent abuse, enforce these Terms, comply with law, or respond to material operational risk. Sections that by their nature should survive termination—including ownership, disclaimers, and limitations of liability—will survive.
14. Changes
We may update these Terms from time to time. The effective date above identifies the current version. If a change is material, we will take reasonable steps to provide notice through the service or by email. Continued use after updated Terms become effective means you accept the revised Terms.
